Kashmiri v. Regents Student Fee Lawsuit

Kashmiri lawsuit refund information

On Jan. 23, 2008, the California Supreme Court denied the University of California’s petition for review of the judgment in favor of plaintiffs in the Kashmiri v. Regents student fee lawsuit. The San Francisco Superior Court will now approve a formula for determining the amount of each class member’s refund and a process for distributing refunds. Refund distributions will be handled by an outside claims administrator, not the university. Class members are encouraged to send their current email and postal addresses to the class action administrator for this case at: lnelson@rustconsulting.com. Any other questions should be directed to the attorneys representing the plaintiff class at: info@browngold.com.

Not having much clue what exactly the lawsuit was, I awaited MsticAzn to get more information.

However yesterday, SkyLancer brings up this same topic and apparently it had to do with UC Regents raising fees after students were enrolled back in 2003. Talking it over with Ungsunghero, he found the lawsuit documentation and apparently only applies to the following group:

  1. Current and former University of California (“UC”) students who enrolled in a UC professional degree program prior to December 16, 2000, and whose professional degree fees were raised after that date.
  2. Students who attended any UC school on a semester system during the Spring 2003 semester, whose fees for that semester increased after they had already enrolled in classes and received bills for the semester.
  3. Students who attended Summer 2003 session at UC Berkeley or UCLA, whose fees for that summer session increased after they had already enrolled and received bills for the session.

So I sent an email to Rust Consulting to find out how to determine if I was eligible for the refund and promptly received a reply back this morning:

Dear Mr. Hon,

Our records indicate that you are included in the Kashmiri v. The Regents of the University of California class. A notification was emailed to all class members to update them on the status of the settlement and to request that contact information be provided to update our records for future mailings. This notification was emailed to you at ********@berkeley.edu as that was the most current information that was available to us. I have included the notification in this email for your information in case you did not receive the previous email.

There is nothing further you need to do other than to keep us notified of any changes to your contact information. The case has been decided in favor of the students; however the trial court must still approve an allocation of recovery. Therefore, we are not certain when you will receive a refund, although it is likely to occur by the end of 2008. The students have created a website, www.educationisaright.org, that should post updates as they become available.

Sincerely,

Linda Nelson

My ********@berkeley.edu email account was pretty much deactivated the day I graduated. I wonder if there’s some place I can go and update that email.

Anyway, here was the original email that was sent out to people:

IMPORTANT NOTICE ABOUT STEPS TO TAKE TO ENSURE YOU RECEIVE INFORMATION ABOUT YOUR POTENTIAL SHARE OF THE UNIVERSITY OF CALIFORNIA FEE OVERCHARGE JUDGMENT

You have been identified by the University of California as a member of the plaintiff class in the class action lawsuit known as Kashmiri v. The Regents of the University of California, which challenged certain fee increases at the University. The $33.8 million judgment in favor of the plaintiffs has been affirmed on appeal and is now final.

You will receive additional information about the distribution of the funds recovered from the University. As we begin this process, we need current e-mail and postal addresses for all class members so that we can send you additional notices and, eventually, a check if you are entitled to one. If you have changed your name, please provide both names. Please provide any updated contact information as soon as you can and if possible by April 21, 2008, by (1) replying to this e-mail (if you are the addressee), (2) sending an e-mail to ucfees@rustconsulting.com, or (3) mailing the information to Kashmiri v. Regents Class Action, P.O. Box 1931, Faribault MN 55021-7186. The information you provide will not be used for any other purpose.

Also, please forward this email to any of your classmates who may be members of the plaintiff class and encourage them to update their contact information. The plaintiffs consist of three subclasses:

1. Current and former University of California (“UC”) students who enrolled in a UC professional degree program prior to December 16, 2002, and whose professional degree fees were raised after that date.

2. Students who attended any UC school on a semester system during the Spring 2003 semester, whose fees for that semester increased after they had already enrolled in classes and received bills for the semester.

3. Students who attended the Summer 2003 session at UC Berkeley or UCLA, whose fees for that summer session increased after they had already enrolled and received bills for the session.

Thank you.

Class Action Administrator

If you believe you qualify for the refund but did not receive an email from them, you should email Rust Consulting to verify if they have your updated information. I’m not sure how the refund is going to be split or how much each person will get, but I assume we’ll find out shortly.

Are Elongated Pennies Legal?

I’m serious that those pennies you crush up or press at theme parks and tourist attraction locations with the location’s emblem are called elongated coins.

Elongated coins are coins that have been flattened, stretched and imprinted with a new design with the purpose of creating a commemorative or souvenir token. The collecting of elongated coins is a branch of numismatics. Elongated coins can also be categorized as exonumia.

I’ve always wondered if it was some trickery or if it was really legal to destroy U.S. issued currency for something silly like these elongated pennies.

But while I was at Snoqualmie Falls, I noticed this sign on the Penny Presser:

penny pressers legality

IS IT LEGAL?

Yes, it is legal to elongate coins under 331, title 18 of the United States Code. It is illegal only if someone fraudulently mutilates the coin, so elongating coins in this manner is legal.

I’m not exactly sure how fraudulently is defined, but does that mean when I defaced all those pennies back in Jr High by rubbing it against the asphalt, that it’s technically legal since I wasn’t defrauding anyone? Ooooh! Shiny! I hope I didn’t just self incriminate myself.

While I was at the Space Needle, I noticed they also have Quarter Pressers. However, they cost 50 cents more. $0.51 = 1 elongated penny. $1.25 = 1 elongated quarter. What a rip off. However, my sister collects them as souvenirs, so oh well.

I guess pennies do have a use after all! And Congress was thinking of scrapping away the penny. Think of all the penny elongators that will have to be scrapped! ;p

Now, if I light my cigarette with a $100 bill, I wonder if that’s still legal:

Shakugan no Shana vs Zero no Tsukaima

louise vs shana So as I mentioned yesterday, I’ve started watching Shakugan no Shana (灼眼のシャナ) and I can’t stop thinking of how much it reminds me of Zero no Tsukaima (ゼロの使い魔).

Not only do they both star a prepubescent girl who’s supposedly very powerful, but her power hasn’t been fully awaken yet, they also feature a clueless guy who basically follows her orders. And of course they both somehow fall in love with each other, but have a hard time expressing so.

Anyway, I did some extra research and it turns out the voice actors for both the main female and male characters are the same!

Hino Satoshi (日野聡) voices both Hiraga Saito (from Zero no Tsukaima) and Sakai Yuji (from Shakugan no Shana).

Kugimiya Rie (釘宮 理恵) voices both Louise (from Zero no Tsukaima) and Shana (from Shakugan no Shana).

If I had to guess, the story/manga is probably done by the same artist/company too.

32-bit Vista SP1 Enables 4GB of RAM?

So I recently found out that my Windows Vista MCE box is now showing all 4.00GB of RAM in System Properties. If you recalled, I had posted about Vista showing only 2,943 MB of RAM, even though BIOS detected all 4GB.

I hadn’t updated any motherboard firmware recently and the only driver updates I installed was my ATI Radeon X1600Pro.

Windows Update did install SP1 about 2 weeks back and that’s the only explanation I can come up that has enabled all 4GB of RAM.

Maybe when they release Windows XP SP3, all 4GB of RAM on my XP box will be enabled. 🙂

The Device Has Been Modified

the device has been modified So I saw this on Digg yesterday and wanted to post it, but decided I’d watch an extra episode Shakugan no Shana of instead. But here it is: The Device Has Been Modified (stream video). If you want to download the 100MB HD version of this, you should be able to find the torrent in the upper left hand corner.

This is actually a cross of a fan-made Portal Song and World of Warcraft video footage. I wasn’t too impressed by the the video footage (unless someone actually did the animation themselves), but the song was super catchy. To describe just how awesome the song is, I’ve accumulated over 8 hours for the past 2 days listening to this song at work and at home. It’s just been playing on repeat. As RayAlome says:

Ray AlOm3: lol
Ray AlOm3: you and ur quasi-portal music
Ray AlOm3: yea i was thinking you might like it
Ray AlOm3: it had that dramatic film quality

And I agree. The music has that sort of grandeur soundtrack feeling to it and I guess that’s what makes it so awesome. I don’t think the robotic voice really did much for me, but I guess if it wasn’t portal related, I wouldn’t have found it.

The best thing, the mp3 is available for download for FREE: Victims of Science – The Device Has Been Modified

Apparently the lyrics were taken from the Portal game itself and mixed with a dance song:

5 Centimeters Per Second – Review

5 Centimeters Per SecondI just watched Makoto Shinkai’s latest masterpiece: 5 Centimeters Per Second (秒速5センチメートル). You might remember Makoto Shinkai from his previous works such as Voices of a Distant Star (ほしのこえ) or The Place Promised in Our Early Days (雲のむこう、約束の場所).

This animated film was so beautiful, yet so heart wrenching, and I think I’m going to be depressed for some time. The drawing was just spectacular and the music/soundtrack was nothing short of Tenmon‘s best. The storyline was so amazingly beautiful, I’m not sure exactly how I feel with such an open ended ending.

Facebook: Friends Suggester

So for the longest time (and Derek can be my witness), I’ve wanted a Friends Suggester feature in Facebook. What a Friends Suggester is is a tool that’ll automatically suggest people who you might know based on who your friends are. In other words, typically if 5 of your friends know a particular person that isn’t your friend yet, there is a likely chance this particular person is someone you know too.

Anyway, when Facebook Apps were starting, I thought an app like this would quickly show up. At first we thought it wasn’t possible due to privacy reasons, but it turns out that your friends list is typically open to public and all the app would need is just the list of friends of all your friends and then do some mashing work.

When Facebook introduced Suggest A Friend, I thought that was what I was looking for. However, it turns out it was meant so you as a human (and not the computer) to suggest friends to new people on Facebook.

A week or 2 ago, Facebook finally added what’s been long overdue: People You May Know:

People You May Know
Found based on your existing connections

Do you know any of these people?
Add people you know as friends to make these results even better for you.

This is exactly what Friends Suggester is. It shows you a list of people that it thinks you might know and even shows the list of common friends between you two. I’ve already added 5+ friends since I found this tool.

There are still some ways to improve it. Currently they only suggest 25 people randomly to you. If you refresh the page, the list changes with some new and some old. There appears to be no order of any sort and algorithm to determine which people you’re more likely to be friends with. I’d say the more friends you share between each other, the more likely you two are friends. Having the ability to see ALL suggested friends, even if it iterates over many pages, would be nice. Sitting here hitting refresh hoping to find a friend that may pop up after awhile just isn’t that great.

Another thing they should add is the ability to discard people you don’t know. No matter how many times you show me person A, if I don’t know him, I’m not going to add him to my friends list. There is the case where you might end up being friends later, so maybe the ability to ignore a particular person for 3 months or 6 months would be another option.

All in all, I’m pretty satisfied with this new tool so far.

Update:

I knew I forgot something. I had also wanted it to automatically email me when it thinks a new possible friend pops up in the list or alert me somehow. However it turns out they already have this feature. I just got this email:

_____ just joined Facebook. You are getting notified of this because our “People You May Know” tool discovered you and _____ both work at Microsoft. If you do know _____, check out the links below.

ATI Catalyst 8.3 Problems with Remote Desktop

So I’ve been having problems connecting to my home PC via Remote Desktop for some time and I didn’t really have a clue on what the problem is. For the longest time, I believed that it had to do with AVG since for some reason AVG would prompt me to reboot every single day and when I don’t, remote desktop appeared not to work anymore. Reinstalling AVG from scratch appeared to have fixed it.

The problems I was hitting included immediately disconnecting from the Terminal Service after logging in with the correct username and password or ending up in a blank screen where I’m not seeing anything. Half time time, I’m able to log into my admin account and log off my default user and retry. Other times, my admin account encounters the same problems.

Anyway today’s problem was the weirdest, where I’d be disconnected immediately when trying to connect. It didn’t even prompt me for credentials. I thought I’ll just go home and reboot the computer, however this apparently didn’t fix the problem. I tried uninstalling AVG to see if that helped, but unfortunately it didn’t appear to be the cause of the problem.

I scratched my head and wondered what else could be causing the problem. I recall since I was going to reboot, I decided to update my graphics drivers. I have an ATI Radeon X1600Pro and upgraded to the latest ATI Catalyst 8.3 for Windows XP. I uninstalled all the ATI crap and rebooted and immediately I was able to connect via Remote Desktop. However my monitor was now running in like 800×600 mode.

I found this thread stating that ATI Catalyst Suite prevented some other people to connect via Remote Desktop:

RDP is working, removing ATI Catalyst Suite did the trick

Hi Scott, just wanted to thank you for your assistance, it ended up being the ATI Catalyst Suite which is installed with the video driver (these servers have ATI Radeon X550’s in them).

Removing the Catalyst Suite and using just the ATI driver alone did the trick. Don’t know why as the Catalyst doesn’t change the video driver, it just gives you a control panel utility. Go figure.

I’ve submitted a KB article request to AMD as it seems to effect at least 5 different Radeon cards that I have.
Thanks again,
Mark

So I went and downloaded the newest Display Driver only and installed that. However, I immediately hit the same Remote Desktop problem again. Grrrrr… I decided to try previous drivers one by one moving backwards and stop after the 1st one that worked. The sucky part of this is after each driver installation, I had to reboot to be able to test if my Remote Desktop connection is fixed. Good news is that after installing ATI Catalyst 8.2 Display Driver, my Remote Desktop connection was in full working order again, so I didn’t have to keep on going. I didn’t bother installing the Catalyst Control Center this time around since I don’t believe there’s any need for me.

In conclusion, it appears a change in ATI Catalyst 8.3 broke compatibility with Remote Desktop (at least on Windows XP).

For others who have encountered this problem, I hope this helps!
